How do I collect attorney fees that my ex-husband was ordered to pay but won’t?

I was receiving child and spousal support. My ex quit paying the spousal support 2 months prior to the judge deciding to terminate it. The judge assumed he paid for the last 2 months, but he really didn’t. The judge ordered the support to be terminated at a retroactive date (2 months prior) and to apply the 2 months of spousal support payments as my attorney fees. Problem is, I never received the 2 months of spousal support payments that are now considered to be monies for my attorney fees.

    File another motion and you’ll get the money soon after he lands in the slammer.

  2. You need to get him back in front of the judge who issued the initial order, and have your attorney explain to the court what happened and superx never paid….he is in contempt of court if he doesn’t pay, and that doesn’t please most family court judges.

  3. You could file a motion with the court to find him in contempt, or you could file a garnishment order.
