I got a DUI and its my first offense, I also live in florida. I know all the rules but my qeustion is?

I need my license for my job and if they find out I will be fired, not too mention driving without a license is not good. I just need hope that it is possible!! I have heard people tell me they have had the charges dropped, I was just wondering if anyone out there has had a similar experience and what was your outcome?

  1. Diversion should be an option for you. It will be a misdemeanor.

  2. Unless you injured or killed someone, it will be a misdemeanor.

    Florida should allow you to apply for a restricted license that will allow you to keep your job.

    Don’t plan on the charges being dropped, I doubt that very much.

  3. when i was in high school, a few of my classmates had charges dropped. THey got them dropped by hiring an atourney and finding loopholes. Also, if for some reason the cop screws up on the paper work, they drop the charges.

  4. you can get driving privileges for work but getting the charges dropped I don’t see it.

    The charge is already a misdemeanor unless someone was hurt. As for getting it dismissed, criminal charges are dismissed all the time, if there is a reason for it. A lawyer experienced in misdemeanor defense will be able to evaluate your case in fairly short order by looking at the police reports and talking to you. There are hundreds of potential flaws in every case but you need to know the right questions to ask to find them.

  6. DUI charges are not dropped to a lower offense. You are either guilty, or not guilty. It is possible that if you are found guilty, you might be able to obtain a restricted license. That will be up to the court, and DMV. If you took a breath test, and the reading was .08, there is a slight chance that you could win the Implied consent hearing on your license because of the variance.

  7. A standard DUI first offense is a misdemeanor. Your best bet is to find an experienced DUI attorney and get ready to pay through the nose to both save your license and your job. A good DUI attorney will probably get you a pre-trial diversion and you’ll have to take DUI classes at your expense. This is not to mention the huge fines the courts impose now. Get ready to dig deep.
