What is the likelihood of jail time for a first offense DUI in Ohio?
I got a DUI on Nov. 5th…went to court in Clinton County, Ohio on the 8th and waived my right to an attorney and just plead guilty so I could just get my punishment over with. The judge sentenced me to 90 days in jail, fines, and license suspension…everyone else there for a DUI plead not guilty after they saw me get sentenced to that. After everyone left the room, he told me that he would give me a chance to do a drivers intervention program and that it would count as 3 days toward the jail sentence and that I would return to court in March to review my sentence and my assessment through the DIP. He stayed (postponed) the sentence and fines until then. I got my license back a couple of weeks ago and i recently wrecked my car when it was all snowy out and got a failure to control citation…this is a basic traffic violation. What is the likelihood of me receiving jail time?

if you have done no damage to society there should be no cause to send you to jail
driving school and AA meeting are what you should be given
You’ll just have to do that stupid DUI weekend at a hotel, otherwise it’s 3 days in jail. They won’t give you any more time in jail on a 1st offense.
It cannot be added to the charge if you were not again drunk. driving is a felony, its like bank robbery,
it was a stinking accident in terrible snow storm. how could that stupid cop find you guilty of anything at all,?
My bet is when he checked out your licence for priors he was just backing himself up .
get a lawyer and take him apart in court they don’t have anything to do with each other.
your DUI.was for driving while drunk,
the fact you were in an accident while the weather was very bad was an accident,
but the cop made a bad call ,
unless he saw you acting stupid you will beat that ticket in a walk.

never plead guilty to anything even if there were fifty witnesses. the court will give you as much respect as the cop and he must admit it was terrible for traffic.
so make them prove you were at fault, because of the weather a lot of cops and emergency people were in accidents all during the storm were they as in fault as you were? i think not.
totally impossible do do so, the cop was looking at your record and thought you would be an easy mark. Lawyer up.
i would say that failure to control was due to weather reasons and as long as nothing else was involved your alright. It really depends on the judge, if he wants to put you in jail he can. but most likely not
